1. Acceptance of Terms

By creating an account or using MedicTranslate (“the Service”), you agree to these Terms and our Privacy Policy. If you do not agree, you must discontinue use immediately.

If you are using the Service on behalf of an organisation, you confirm you have authority to do so.

2. Eligibility

You must be at least 18 years old to use the Service. We do not knowingly allow use by individuals under 16.

3. Account Registration and Security

You must provide accurate information and maintain the confidentiality of your login credentials. You are responsible for all activities that occur under your account.

We may suspend or terminate access for misuse, policy violations, suspicious activity, or legal/security requirements.

4. Description of Services

MedicTranslate provides medical document translation, interpreter booking (via Calendly), document preparation support, and AI-assisted translation with human review.

Not Medical Advice: The Service does not provide medical advice, diagnosis or treatment. Translated documents should not be used as a substitute for professional clinical judgement.

5. Use of Uploaded Documents

By uploading documents, you confirm:

• You have lawful authority to upload and request translation.

• You grant MedicTranslate a limited licence to process, translate and store the documents solely for the purpose of providing the Service.

• AI Governance: You understand that while we use AI assistance, we do not use your documents to train or improve public AI models.

6. Data Storage and Region Segregation

MedicTranslate uses region-specific AWS infrastructure:

• Japan clients: AWS Tokyo (ap-northeast-1)

• Australian clients: AWS Sydney (ap-southeast-2)

  We do not store, transfer or process medical documents across borders. Only non-medical metadata may be processed in Australia where required due to AWS service availability.

7. Data Retention

You may delete files at any time. If not deleted earlier, uploaded files and translated output are automatically and permanently deleted within 7 days of completion. Storage extensions are not offered except where requested in writing.

8. Acceptable Use & Indemnity

You must not upload unlawful content, attempt to access another user’s data, reverse engineer the Service, or use third-party AI tools on uploaded documents.

Indemnity: You agree to indemnify and hold MedicTranslate harmless from any claims, damages, or legal costs arising from your violation of these Terms or your violation of any third-party rights (including copyright or privacy).

9. Payments & Refunds

• Payments: Processed securely by Stripe. You agree to provide valid payment information.

• No Refunds: Due to the immediate nature of the costs incurred (translator fees and server processing), all fees are non-refundable once the translation process has commenced, except where required by mandatory consumer law.

10. Service Availability

We aim to make the Service available reliably but do not guarantee uninterrupted operation. We are not liable for downtime caused by maintenance, upgrades, or external provider outages (AWS, Stripe, Calendly).

11. Limitation of Liability

To the extent permitted by law, MedicTranslate’s liability is limited to the fees paid for the relevant service. We are not liable for consequential, indirect or incidental damages. This limitation does not apply in cases of intent or gross negligence.

12. Termination

We may suspend or terminate accounts for breach of these Terms. Upon termination, access is revoked, and files are deleted in accordance with the 7-day policy. Your obligations regarding confidentiality and indemnification continue.

13. Intellectual Property

All content, branding, workflows and materials are the property of MedicTranslate. Documents you upload remain your property.

14. Modifications to the Terms

We may update these Terms from time to time. Material updates will be communicated through the website or email where legally required.

15. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Japan.

Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the Osaka District Court as the court of first instance.

1. 利用規約への同意

利用者がアカウントを作成し、または本サービス（MedicTranslate）を利用することにより、本利用規約およびプライバシーポリシーに同意したものとみなします。組織を代表して利用する場合、その権限を有していることを保証するものとします。

2. 利用条件

本サービスの利用には 18歳以上 であることが必要です。16歳未満の個人情報は収集しません。

3. アカウント管理

利用者は正確な情報を提供し、ログイン情報の管理責任を負います。

当社は、規約違反、不正利用、セキュリティ上の懸念、または法的要請がある場合、アクセスを制限または停止することがあります。

4. サービス内容

当社は、医療文書の翻訳、通訳予約（Calendly）、文書サポート、およびAWSを用いた自動翻訳（人間による確認付き）を提供します。

医療アドバイスではありません: 本サービスは診断・治療・医療行為を目的としたものではありません。翻訳文書は専門家による医療判断の代替にはなりません。

5. アップロード文書の取り扱い

利用者は以下を保証します。

• 翻訳依頼を行う適法な権限を有すること

• アップロードされた文書の翻訳・処理のために当社に限定的使用許諾を与えること

• AIガバナンス: 当社はAI支援を使用しますが、利用者の文書を公共AIモデルの学習に使用することはありません。

6. データ保存とリージョン分離

当社は地域ごとに保存先を厳格に分離します。

• 日本の利用者: AWS 東京リージョン

• オーストラリアの利用者: AWS シドニーリージョン

  医療文書の越境移転は一切行いません。AWSの仕様上必要な場合でも、国外処理されるのは非医療メタデータのみです。

7. データの保存期間

利用者はいつでも文書を削除できます。削除されない場合、アップロード文書および翻訳結果は完了から7日後に自動かつ完全に削除されます。延長は原則行いません。

8. 禁止事項および免責・補償

不法な文書のアップロード、他者データへの不正アクセス、サービスのリバースエンジニアリング、または外部AIツールへのアップロードを禁止します。

補償 (Indemnity): 利用者が本規約に違反したこと、または第三者の権利（著作権やプライバシー等）を侵害したことに起因して当社に損害が生じた場合、利用者はその損害（弁護士費用を含む）を補償することに同意します。

9. 支払いおよび返金

• 支払い: Stripeにより処理されます。

• 返金不可: 翻訳プロセスが開始された時点でコスト（翻訳者報酬等）が発生するため、強行法規により要求される場合を除き、原則として返金は行いません。

10. サービスの可用性

当社は安定したサービス提供に努めますが、AWS、Stripe、Calendlyの障害、メンテナンス等により中断する場合があります。当社はこれらによる損害に責任を負いません。

11. 責任の制限

適用法で認められる最大限の範囲で、当社の責任は該当サービスの利用料金総額を上限とします。間接損害・特別損害には責任を負いません。ただし、当社に故意または重過失がある場合はこの限りではありません。

12. 契約解除

規約違反等があった場合、当社はアカウントを停止または解除できます。解除後、アクセスは即時停止され、文書は7日ルールに基づき削除されます。秘密保持および補償の義務は継続します。

13. 知的財産

本サービスに関するコンテンツ・ロゴ等は当社の財産です。利用者がアップロードした文書の所有権は利用者に帰属します。

14. 規約の変更

当社は必要に応じて規約を変更することがあります。重要な変更はウェブサイトまたはメールで通知します。

15. 準拠法および管轄裁判所

本規約は日本法に準拠します。

本規約または本サービスに起因または関連する一切の紛争については、大阪地方裁判所を第一審の専属的合意管轄裁判所とします。
