Terms of Use
These Terms govern access to MedicTranslate’s website and the purchase and use of medical translation, interpreting, clinic coordination, medication-document and related services.
Both versions are intended to express the same agreement. See the Language section regarding interpretation.
Scope and orders
Your accepted quotation or confirmation defines the service, fee and delivery assumptions.
Medical boundaries
Language and coordination support does not replace healthcare, legal or regulatory advice.
Bookings and refunds
Cancellation, rescheduling and refund outcomes depend on work completed and committed costs.
Mandatory rights
Nothing removes consumer or other statutory rights that cannot lawfully be excluded.
Read these Terms together with the accepted quotation or order confirmation and the Privacy Policy. Service-specific conditions may apply to interpreting, urgent work, certification, appointment coordination or third-party professional services.
Acceptance and contractual framework
These Terms of Use (“Terms”) govern access to and use of the MedicTranslate website, customer portal and services supplied by 株式会社MedicTranslate, trading as MedicTranslate (“MedicTranslate”, “we”, “us” or “our”).
By submitting an enquiry, requesting a quotation, creating an account, uploading material, accepting a quotation, making a payment or using a service, you confirm that you have read and agree to these Terms and any service-specific terms incorporated into the applicable quotation, order confirmation, booking confirmation or statement of work.
If you act for another individual or organisation, you warrant that you have authority to bind that person or organisation and to provide the information submitted.
If documents conflict, the following order applies unless expressly agreed otherwise in writing: signed agreement or statement of work; accepted quotation or order confirmation; service-specific conditions; these Terms; website descriptions.
Eligibility, authority and minors
You must be at least 18 years old and legally capable of entering into a contract to purchase services directly.
A parent, legal guardian or other legally authorised representative may request services concerning a minor or another person who cannot contract independently. We may require evidence of identity, guardianship, consent or authority before accepting the request.
Use of the website from a particular country does not mean that our services are lawful, suitable or available in every jurisdiction. You are responsible for complying with laws applicable to you.
Services and role of MedicTranslate
MedicTranslate may provide medical and general document translation, AI-assisted translation with human validation, interpreting, appointment coordination, healthcare navigation, medication and customs-document support, document certification or notary coordination, and related administrative services.
The precise scope, language pair, delivery format, timing, professional involvement and fee are those stated in the accepted quotation or order confirmation.
MedicTranslate is a language, communication and coordination provider. Unless expressly stated in a separate written agreement, we are not a hospital, clinic, pharmacy, medical practitioner, legal practice, immigration adviser, customs authority, insurer or government agency.
Medical, legal and regulatory disclaimer
Our translations, interpretations and support services facilitate communication. They do not constitute medical diagnosis, treatment, prescribing, legal advice, immigration advice, customs approval or regulatory approval.
Medical assessment and treatment decisions remain solely with appropriately qualified healthcare professionals. Legal, customs, immigration, tax and regulatory decisions remain with the relevant qualified adviser or authority.
You must not delay or disregard professional advice because of information supplied through our website or services.
MedicTranslate is not an emergency service. Do not use the website, email, portal or ordinary booking channels for a medical emergency. Contact the local emergency service or attend the nearest emergency department.
Quotations, orders and contract formation
Website descriptions and indicative prices are invitations to enquire and do not constitute binding offers.
A contract is formed when we issue written acceptance, confirm a booking, commence work following your instruction, or receive payment against an accepted quotation, whichever occurs first.
Quotations may be based on estimated word count, page count, language pair, document condition, urgency, formatting, certification, interpreter duration, travel or other disclosed assumptions. We may revise a quotation if the supplied material or requirements differ materially from those assumptions.
Unless stated otherwise, a quotation expires on the date shown in it or, if no expiry date is shown, 14 days after issue.
Customer materials and instructions
You must provide complete, accurate, legible and lawful materials and instructions, including the intended purpose, target language, required format, deadline, terminology preferences and any known clinical or regulatory context relevant to the service.
You warrant that you have all rights, consents and lawful authority required to submit the materials and permit us and our authorised providers to process them for the requested service.
You must not submit unnecessary personal information or material that infringes copyright, confidentiality, privacy, professional secrecy, court orders or other legal obligations.
We are not responsible for errors, delay or additional cost caused by incomplete, inaccurate, illegible, ambiguous, corrupted or late materials or instructions.
Sensitive information and authorisations
Where materials contain health, identity, financial, travel or other sensitive information, you confirm that submission is necessary for the requested service and that any required consent, notice or authority has been obtained.
If information concerns another person, you must provide that person with access to our Privacy Policy where reasonably practicable and must not falsely represent your authority.
We may pause work while authority, identity or consent is verified.
AI-assisted processing and human validation
Approved artificial intelligence, machine translation, optical character recognition, terminology-management and document-processing tools may assist our workflow.
Where human validation is included in the selected service, an authorised translator, reviewer, interpreter or other qualified person reviews the relevant output. Human validation reduces risk but does not guarantee that every output is error-free.
Identifiable customer medical documents are not used to train MedicTranslate’s own general-purpose AI models. Approved AI, OCR and machine-translation providers are selected and configured so customer content is not used for general-purpose model training, subject to the agreed service configuration and applicable law.
AI tools do not independently diagnose, prescribe, recommend treatment or determine access to healthcare.
Delivery, review and acceptance
Delivery dates are estimates unless a guaranteed deadline is expressly stated in writing. Time begins when we have received all required materials, instructions, approvals and payment.
You must review deliverables promptly and notify us of any alleged error, omission or non-conformity with reasonable detail.
Unless a different review period is stated in the quotation, correction requests should be submitted within 7 days after delivery. This review period does not remove any non-excludable statutory right.
Changes to the source material, instructions, purpose, language, formatting or scope after work begins may be treated as additional work and may require a revised fee or delivery date.
Corrections and revisions
Where a deliverable materially fails to conform to the accepted instructions because of our error, we will, subject to applicable law, use reasonable efforts to correct the affected portion without additional professional fee.
Corrections do not include preference changes, new source content, changes in intended purpose, terminology not previously supplied, third-party edits, formatting changes outside the agreed scope or revisions required because the source was ambiguous or inaccurate.
Certified, notarised, apostilled or otherwise finalised documents may require new third-party fees if they must be reissued.
Interpreting services
Interpreter availability is not guaranteed until confirmed. You must provide accurate appointment details, expected duration, location or connection method, subject matter and language requirements.
Interpreters facilitate communication and do not provide medical, legal or other professional advice. Participants remain responsible for verifying important clinical, legal, consent and procedural decisions.
Bookings are charged for the confirmed minimum duration and may include preparation, travel, waiting time, overtime and expenses as stated in the quotation.
If an appointment runs beyond the booked period, continued interpreter attendance is subject to availability and additional charges.
Clinic, hospital and appointment coordination
MedicTranslate may contact healthcare providers, request availability and transmit information authorised by you. We do not control whether a provider accepts a patient, offers a particular treatment, changes an appointment, requires additional documentation or charges separate fees.
An appointment is not confirmed until written confirmation is issued by MedicTranslate or the healthcare provider.
The healthcare provider is solely responsible for clinical assessment, diagnosis, treatment, consent, prescribing, billing and patient safety.
Medication, customs and travel-document support
MedicTranslate may assist with translation, preparation and coordination of medication, customs or import-related documents. We do not guarantee approval, entry, importation, clearance, processing time or acceptance by any authority, airline, courier, clinic or pharmacy.
You are responsible for confirming current legal requirements, permitted quantities, prohibited or controlled substances, original-document requirements and submission deadlines with the relevant authority.
Do not travel with medication solely in reliance on a translation or draft document without verifying official requirements.
Third-party certification, notary and professional services
Where requested, we may coordinate services supplied by notaries, translators, clinics, laboratories, couriers, apostille agents, lawyers or other independent professionals.
Third-party acceptance, availability, professional judgement, fees and processing times are outside our control. Separate third-party terms may apply.
We may collect third-party charges in advance or act as a disclosed coordinator. Unless expressly stated otherwise, the third party remains responsible for its own professional service.
Fees, currency, taxes and payment
You must pay the fees, taxes, expenses and third-party charges stated in the accepted quotation or order confirmation.
Prices are stated in the currency shown and may exclude bank charges, foreign-exchange charges, withholding, consumption tax, GST, VAT or other applicable taxes unless expressly stated otherwise.
Payment is due at the time stated in the quotation or invoice. We may require full or partial advance payment and may suspend work or withhold delivery while an amount is overdue.
Payment providers, including Stripe, may apply their own terms and security checks. We do not ordinarily store complete payment-card numbers or security codes on our own servers.
Cancellations, rescheduling and refunds
Cancellation and rescheduling rights depend on the service, timing, professional commitments and work already performed.
- Translation or document work may be charged for work completed, committed professional time, non-recoverable third-party costs and administrative processing incurred before cancellation.
- Interpreter and appointment bookings may be subject to minimum charges or cancellation fees stated in the quotation or booking confirmation.
- Urgent, customised, certified, notarised or completed services may not be refundable except where required by law.
Any refund will be made to the original payment method where reasonably practicable and may be reduced by lawful non-recoverable third-party or payment-processing costs.
Nothing in these Terms excludes, restricts or modifies a consumer guarantee, remedy or other right that cannot lawfully be excluded under applicable consumer law.
Privacy, confidentiality and data handling
Personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.
We apply confidentiality and access restrictions to customer materials and may disclose them only as reasonably necessary to authorised personnel, assigned professionals, approved service providers, healthcare organisations, advisers and authorities.
Uploaded medical documents and completed translation outputs are removed from the active customer-service environment within 7 days after delivery or project closure, unless a different period is authorised or retention is required for legal, security, backup, dispute or continuing-service purposes.
You are responsible for securely storing downloaded deliverables and for using an appropriate transmission method when sharing sensitive documents.
Acceptable use
You must not use the website or services to:
- violate any law, professional obligation, court order, sanction or export-control requirement;
- submit unlawful, fraudulent, deceptive, defamatory, threatening, exploitative or infringing material;
- impersonate another person or misrepresent authority, identity, medical condition or documentation;
- obtain or facilitate false prescriptions, fraudulent certificates, unlawful medication importation or improper access to healthcare;
- introduce malware, probe security, bypass access controls, scrape restricted content or disrupt systems;
- use deliverables to mislead a healthcare provider, authority, insurer, employer or court; or
- resell or systematically reproduce the service without written permission.
We may investigate suspected misuse and may preserve or disclose relevant information where legally permitted or required.
Accounts and security
You are responsible for maintaining the confidentiality of account credentials, access links and devices and for all activity undertaken through your account unless caused by our breach.
You must notify us promptly of suspected unauthorised access, incorrect document delivery, compromised credentials or other security concerns.
We may require password changes, multi-factor authentication, identity verification or other reasonable security steps.
Intellectual property
The MedicTranslate name, logo, website, software, templates, design, workflow, databases, general glossaries and original content are owned by or licensed to MedicTranslate and protected by intellectual-property laws.
Subject to full payment, you receive a non-exclusive licence to use the final deliverable for the purpose disclosed when ordering. Ownership of your source materials remains with you or the relevant rights holder.
You grant us and our authorised providers a limited, non-exclusive licence to reproduce, process, translate, format and transmit customer materials solely to provide, secure and administer the requested service and meet legal obligations.
Pre-existing tools, methods, terminology resources and know-how remain the property of their respective owners. De-identified terminology may be incorporated into internal glossaries as described in the Privacy Policy.
Third-party websites, platforms and communications
The website or services may link to or rely on third-party platforms, including cloud, payment, booking, video, messaging, map, analytics and healthcare systems.
Third parties operate under their own terms and privacy policies. We are not responsible for independent third-party content, availability, security or decisions, except to the extent liability cannot lawfully be excluded.
Email and ordinary messaging channels may carry security risks. Use the secure upload or communication method made available for sensitive documents where practicable.
Service availability and changes
We aim to provide reliable services but do not guarantee uninterrupted, error-free or universally available access.
We may perform maintenance, modify features, replace providers, change workflows, restrict access or discontinue a service where reasonably necessary for security, compliance, quality, availability or business reasons.
Where a material change affects an accepted order, we will use reasonable efforts to provide an appropriate alternative, revised timing or remedy required by law.
Events outside reasonable control
We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disaster, severe weather, epidemic, war, terrorism, civil disorder, government action, border restriction, labour dispute, telecommunications or cloud outage, cyberattack, utility failure, transport disruption, illness or unavailability of an independent professional.
We will use reasonable efforts to mitigate the impact and resume the affected service. This clause does not exclude rights that cannot lawfully be excluded.
Warranties and disclaimers
We will provide services with the level of care and skill required by applicable law and in substantial accordance with the accepted service description.
Subject to non-excludable rights, we do not warrant that:
- a translation or interpretation will be completely error-free or suitable for an undisclosed purpose;
- a clinic, authority, court, airline, pharmacy, insurer or other third party will accept a document or request;
- a particular professional, appointment, treatment, visa, import approval or regulatory outcome will be available;
- third-party systems will operate without interruption; or
- website information will remain current for every jurisdiction.
Limitation of liability
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability for fraud, wilful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where applicable, or breach of a non-excludable consumer guarantee.
To the maximum extent permitted by law, MedicTranslate is not liable for indirect, consequential, special or punitive loss, loss of profit, revenue, opportunity, reputation or anticipated savings, or loss arising from an undisclosed intended use, third-party decision, customer error, inaccurate source material or failure to follow professional advice.
Where liability may lawfully be limited, our aggregate liability arising from a particular service is limited, at our option where permitted, to re-supplying the affected service, paying the reasonable cost of re-supply, or refunding the amount paid for the affected service.
Any monetary cap does not apply to the extent a court determines that applying it would be unlawful or unreasonable under mandatory law.
Customer responsibility and indemnity
You are responsible for decisions made using the deliverables, for obtaining appropriate professional review where required and for ensuring that documents are suitable for their intended legal, clinical, customs, immigration, insurance or regulatory use.
To the extent permitted by law, you indemnify MedicTranslate against third-party claims, losses and reasonable costs arising from your unlawful materials, lack of authority, infringement of third-party rights, fraudulent or prohibited use, or material breach of these Terms.
This indemnity does not apply to the extent the loss was caused by MedicTranslate’s breach, negligence or unlawful conduct.
Suspension and termination
We may suspend or terminate access or an order where:
- payment is overdue;
- required information, consent or authority is not provided;
- we reasonably suspect unlawful, fraudulent, unsafe or abusive use;
- continued performance would breach law, professional obligations or provider requirements;
- security or system integrity is at risk; or
- you materially breach these Terms and fail to remedy the breach where it is capable of remedy.
Termination does not affect accrued rights, payment obligations, confidentiality, intellectual property, liability provisions or clauses intended to survive termination.
Complaints and dispute resolution
Please send service complaints to info@medictranslate.com with the order reference, relevant facts and requested outcome.
We will seek to acknowledge the complaint, investigate it and provide a substantive response within a reasonable period. Privacy complaints are handled under the Privacy Policy.
Before commencing court proceedings, each party should attempt in good faith to resolve the dispute through direct discussion, except where urgent injunctive relief, a statutory complaint process or immediate legal action is reasonably necessary.
Changes to these Terms
We may update these Terms for legal, regulatory, security, technical or operational reasons.
The version published when an order is accepted generally applies to that order unless a change is required by law, agreed with you or is clearly beneficial and does not materially prejudice you.
Material changes affecting ongoing accounts or services will be notified where required by law.
General legal provisions
Assignment
You may not transfer an order or these Terms without our written consent. We may transfer our rights and obligations as part of a genuine corporate restructuring or business transfer, subject to applicable law and privacy obligations.
Severability
If a provision is invalid or unenforceable, it will be read down to the minimum extent necessary or severed, and the remaining provisions continue.
No waiver
Failure or delay in enforcing a right is not a waiver of that right.
Entire agreement
The applicable accepted quotation, order confirmation, service-specific terms, Privacy Policy and these Terms constitute the agreement concerning the service, except for representations or rights that cannot lawfully be excluded.
Electronic communications
You consent to receiving contractual notices and service communications electronically, subject to applicable law.
Governing law and jurisdiction
These Terms are governed by the laws of Japan, without excluding any mandatory consumer protection or other rights that apply regardless of that choice.
Subject to any mandatory forum or statutory dispute right, the Kobe District Court has exclusive jurisdiction as the court of first instance over disputes arising from these Terms or the services.
Nothing in this clause prevents a consumer from using a regulator, tribunal, court or dispute process available under mandatory law.
Language
These Terms are provided in English and Japanese. Both versions are intended to express the same agreement.
If there is an inconsistency, the Japanese version prevails to the extent permitted by applicable law. Mandatory rights under the law applicable to the customer are not affected.

本規約は、承諾済見積書または注文確認書およびプライバシーポリシーと併せてお読みください。通訳、緊急対応、認証、予約調整または第三者専門サービスには個別条件が適用される場合があります。
規約への同意および契約関係
本利用規約(以下「本規約」)は、株式会社MedicTranslate(以下「当社」)が提供するウェブサイト、顧客ポータルおよび各種サービスの利用条件を定めるものです。
問い合わせ、見積依頼、アカウント作成、資料のアップロード、見積の承諾、支払またはサービス利用を行うことにより、利用者は、本規約ならびに見積書、注文確認書、予約確認書または業務仕様書に含まれる個別条件を確認し、同意したものとします。
他の個人または法人を代理して利用する場合、利用者は、その者を法的に拘束し、情報を提供する権限を有することを表明し保証します。
書面間に矛盾がある場合、別段の書面合意がない限り、署名済契約書・業務仕様書、承諾済見積書・注文確認書、サービス固有条件、本規約、ウェブサイト記載の順で優先します。
利用資格、権限および未成年者
サービスを直接購入する方は、18歳以上であり、契約を締結する法的能力を有している必要があります。
親権者、法定後見人またはその他法的権限を有する代理人は、未成年者または独立して契約できない方に関するサービスを依頼できます。当社は本人確認、親権、同意または代理権を示す資料を求める場合があります。
サービス内容および当社の役割
当社は、医療・一般文書翻訳、AI支援翻訳および人による確認、通訳、予約調整、医療機関受診支援、医薬品・税関関連書類支援、公証・認証等の調整および関連事務サービスを提供する場合があります。
具体的な業務範囲、言語、納品形式、納期、専門職の関与および料金は、承諾済見積書または注文確認書に記載された内容によります。
当社は言語、コミュニケーションおよび調整サービス提供者であり、別途書面合意がない限り、病院、診療所、薬局、医療従事者、法律事務所、入管・税関アドバイザー、保険会社または行政機関ではありません。
医療・法律・規制上の免責
翻訳、通訳および支援サービスは、コミュニケーションを補助するものであり、医学的診断、治療、処方、法律相談、入管相談、税関承認または規制承認を構成しません。
医学的判断は資格を有する医療従事者が行い、法律、税関、入管、税務および規制上の判断は、適切な専門家または所管機関が行います。
当社は緊急サービスではありません。医療上の緊急事態には、ウェブサイト、Eメール、ポータルまたは通常の予約手段を使用せず、現地の救急機関へ連絡するか、最寄りの救急医療機関を受診してください。
見積、注文および契約成立
ウェブサイト上の説明および参考価格は問い合わせの案内であり、法的拘束力のある申込みではありません。
当社が書面で受諾した時、予約を確認した時、利用者の指示に基づき業務を開始した時、または承諾済見積に対する支払を受領した時のうち、最も早い時点で契約が成立します。
資料または要件が見積時の前提と大きく異なる場合、当社は見積を変更できます。
利用者資料および指示
利用者は、完全、正確、判読可能かつ適法な資料および指示を提供し、利用目的、対象言語、形式、期限、用語上の希望ならびに必要な臨床・規制上の背景を伝えるものとします。
利用者は、提出資料を当社および承認された委託先が処理するために必要な権利、同意および権限を有することを保証します。
不完全、不正確、不鮮明、曖昧、破損または遅れて提出された資料・指示に起因する誤り、遅延または追加費用について、当社は責任を負いません。
要配慮情報および権限
健康、本人確認、金融、渡航その他要配慮情報を含む資料を提出する場合、利用者は、提出が依頼サービスに必要であり、必要な同意、通知または権限を取得していることを確認します。
当社は、権限、本人確認または同意が確認されるまで業務を保留する場合があります。
AI支援処理および人による確認
承認されたAI、機械翻訳、光学文字認識、用語管理および文書処理ツールを業務補助に利用する場合があります。
選択されたサービスに人による確認が含まれる場合、権限を付与された翻訳者、レビュー担当者、通訳者または適切な担当者が出力を確認します。ただし、全ての誤りが完全に排除されることを保証するものではありません。
個人を識別可能な顧客医療文書を、当社の汎用AIモデルの学習に使用しません。承認されたAI、OCRおよび機械翻訳サービスは、合意された設定および適用法令に従い、顧客コンテンツが汎用モデル学習に使用されないよう選定・設定されます。
納品、確認および受領
保証期限が書面で明示されている場合を除き、納期は見込みです。必要資料、指示、承認および支払を全て受領した時点から作業期間を計算します。
利用者は納品物を速やかに確認し、誤り、欠落または不適合がある場合は具体的な内容を通知してください。別段の定めがない限り、訂正依頼は納品後7日以内に行ってください。この期間は、法令上排除できない権利を制限するものではありません。
訂正および修正
当社の誤りにより納品物が承諾済指示に重大に適合しない場合、適用法令に従い、影響部分を追加の専門作業料なしで訂正するよう合理的に努めます。
表現上の好み、新規原文、利用目的の変更、未提供用語、第三者による編集、範囲外の書式変更または曖昧・不正確な原文に起因する変更は、無償訂正に含まれません。
通訳サービス
通訳者の確保は予約確定まで保証されません。利用者は、正確な日時、予定時間、場所または接続方法、分野および言語要件を提供してください。
通訳者はコミュニケーションを支援するものであり、医療、法律その他専門的助言を提供しません。
確認済最低時間、準備、移動、待機、延長および経費について、見積または予約確認に従い料金が発生する場合があります。
医療機関および予約調整
当社は、利用者の承認に基づき医療機関へ連絡し、空き状況を確認し、情報を送信する場合があります。当社は、患者受入れ、治療提供、予約変更、追加資料、別料金等を管理または保証しません。
予約は、当社または医療機関から書面の確定通知が発行されるまで確定しません。
医薬品、税関および渡航書類支援
当社は医薬品、税関または輸入関連書類の翻訳、作成補助および調整を行う場合がありますが、行政機関、航空会社、配送業者、医療機関または薬局による承認、入国、輸入、通関、処理時間または受理を保証しません。
利用者は、最新の法的要件、数量制限、禁止・規制薬物、原本要件および期限を所管機関へ確認する責任を負います。
第三者による認証、公証および専門サービス
公証人、翻訳者、医療機関、検査機関、配送業者、アポスティーユ代行者、弁護士その他独立専門職によるサービスを調整する場合があります。
第三者の受理、可用性、専門判断、料金および処理期間は当社の管理外であり、第三者独自の条件が適用される場合があります。
料金、通貨、税金および支払
利用者は、承諾済見積書または注文確認書に記載された料金、税金、経費および第三者費用を支払うものとします。
価格は表示通貨で示され、別段の明示がない限り、銀行手数料、為替手数料、源泉税、消費税、GST、VATその他税金を含まない場合があります。
当社は前払または一部前払を求め、未払がある間、業務または納品を停止できます。
キャンセル、日程変更および返金
キャンセルおよび日程変更の条件は、サービス内容、通知時期、専門職の確保および既に実施された業務によります。
- 翻訳・文書業務では、キャンセル時点までの作業、確保済専門時間、回収不能な第三者費用および事務費用が請求される場合があります。
- 通訳・予約では、見積または予約確認に記載された最低料金またはキャンセル料が適用される場合があります。
- 緊急、個別制作、認証、公証または完了済サービスは、法令上必要な場合を除き返金対象外となる場合があります。
本規約は、適用される消費者法その他法令により排除、制限または変更できない保証、救済または権利を排除しません。
個人情報、秘密保持およびデータ取扱い
個人情報は、本規約の一部を構成する当社プライバシーポリシーに従い取り扱います。
顧客資料には秘密保持およびアクセス制限を適用し、必要な範囲で権限を有する担当者、専門職、承認されたサービス提供者、医療機関、専門アドバイザーおよび公的機関へ提供する場合があります。
アップロードされた医療文書および完成翻訳は、別の期間が承認された場合または法令、セキュリティ、バックアップ、紛争もしくは継続サービス上必要な場合を除き、納品または案件終了後7日以内に通常の顧客サービス環境から削除されます。
禁止事項
利用者は、以下の目的または方法でウェブサイトまたはサービスを利用してはなりません。
- 法令、専門職義務、裁判所命令、制裁または輸出管理に違反する行為
- 違法、詐欺的、虚偽、脅迫的または権利侵害資料の提出
- なりすましまたは権限、本人、病状もしくは書類の虚偽表示
- 虚偽処方、偽造証明、不法な医薬品輸入または不正な医療アクセス
- マルウェア導入、セキュリティ探索、アクセス制御回避またはシステム妨害
- 医療機関、行政機関、保険会社、雇用主または裁判所を誤認させる利用
アカウントおよびセキュリティ
利用者は、アカウント認証情報、アクセスリンクおよび端末を安全に管理する責任を負います。
不正アクセス、誤送信、認証情報の侵害その他セキュリティ上の懸念を認識した場合、速やかに当社へ通知してください。
知的財産権
MedicTranslateの名称、ロゴ、ウェブサイト、ソフトウェア、テンプレート、デザイン、ワークフロー、データベース、一般用語集および当社独自コンテンツは、当社またはライセンサーに帰属します。
料金全額の支払を条件として、利用者は注文時に開示した目的のために最終納品物を利用する非独占的権利を得ます。原資料の権利は利用者または正当な権利者に残ります。
利用者は、サービス提供、セキュリティ管理および法令遵守のために必要な範囲で、顧客資料を複製、処理、翻訳、整形および送信する限定的権利を当社および承認された委託先に許諾します。
第三者ウェブサイト、プラットフォームおよび通信
当社サービスは、クラウド、決済、予約、ビデオ、メッセージ、地図、解析および医療システム等の第三者プラットフォームを利用する場合があります。
第三者には独自の利用条件およびプライバシーポリシーが適用されます。機微な資料には、可能な限り当社が提供する安全なアップロードまたは通信方法を使用してください。
サービスの可用性および変更
当社は安定したサービス提供に努めますが、中断、エラーまたは全地域での利用可能性を保証しません。
セキュリティ、法令遵守、品質、可用性または事業上合理的に必要な場合、保守、機能変更、委託先変更、アクセス制限またはサービス終了を行う場合があります。
合理的支配を超える事由
自然災害、悪天候、感染症、戦争、テロ、騒乱、行政措置、国境制限、労働争議、通信・クラウド障害、サイバー攻撃、停電、輸送障害、疾病または独立専門職の不在等、当社の合理的支配を超える事由による遅延または不履行について、当社は責任を負いません。
保証および免責
当社は、適用法令が要求する注意と技能をもって、承諾済サービス内容に実質的に従いサービスを提供します。
法令上排除できない権利を除き、翻訳・通訳が完全に無誤であること、開示されていない目的に適合すること、第三者が文書または依頼を受理すること、特定の専門職、予約、治療、査証、輸入承認または規制結果が得られることを保証しません。
責任制限
本規約は、詐欺、故意、法令上制限できない重過失、適用される場合の過失による死亡・人身損害、または排除できない消費者保証違反等、法令上排除または制限できない責任を排除しません。
法令で認められる最大限の範囲で、当社は間接損害、結果損害、特別損害、懲罰的損害、利益・収益・機会・信用・期待節約の喪失、非開示目的、第三者判断、利用者の誤り、不正確な原資料または専門家助言不遵守に起因する損害について責任を負いません。
法令上制限可能な場合、特定サービスに関する当社の責任は、影響サービスの再提供、合理的な再提供費用または支払済当該サービス料金の返金のいずれかに限定されます。
利用者責任および補償
利用者は、納品物を使用して行う判断、必要な専門家確認および法的、臨床、税関、入管、保険または規制上の目的への適合確認について責任を負います。
法令で認められる範囲で、違法資料、権限欠如、第三者権利侵害、詐欺的・禁止利用または本規約の重大違反に起因する第三者請求等について当社を補償します。ただし、当社の違反、過失または違法行為に起因する範囲を除きます。
停止および契約終了
未払、必要情報・同意・権限の欠如、違法・詐欺的・危険・ abusive な利用の合理的疑い、法令・専門職義務違反の可能性、セキュリティリスクまたは本規約の重大違反がある場合、当社はアクセスまたは注文を停止・終了できます。
契約終了は、既に発生した権利、支払義務、秘密保持、知的財産、責任および終了後も存続すべき条項に影響しません。
苦情および紛争解決
サービスに関する苦情は、注文番号、事実関係および希望する解決内容を記載し、info@medictranslate.comへ送付してください。
当社は受領確認、調査および合理的期間内の実質的回答に努めます。プライバシーに関する苦情はプライバシーポリシーに従います。
緊急差止め、法定苦情手続または即時法的措置が必要な場合を除き、裁判前に誠実な協議による解決を試みるものとします。
本規約の変更
当社は、法令、規制、セキュリティ、技術または運用上の理由により本規約を変更できます。
原則として、注文承諾時に掲載された版が当該注文に適用されます。ただし、法令上必要な場合、合意した場合、または利用者を重大に不利益にしない有利な変更を除きます。
一般条項
譲渡
利用者は当社の書面同意なく注文または本規約上の地位を移転できません。当社は、法令およびプライバシー義務に従い、真正な組織再編または事業譲渡に伴い権利義務を移転できます。
分離可能性
ある条項が無効または執行不能である場合、必要最小限の範囲で修正または分離され、残りの条項は存続します。
権利放棄の否定
権利行使の不作為または遅延は、その権利の放棄を意味しません。
完全合意
承諾済見積、注文確認、個別条件、プライバシーポリシーおよび本規約が、法令上排除できない表示または権利を除き、当該サービスに関する合意を構成します。
準拠法および管轄
本規約は日本法に準拠します。ただし、法選択にかかわらず適用される強行的な消費者保護その他の権利を排除しません。
強行的な管轄または法定紛争手続に反しない限り、本規約またはサービスに起因する紛争について、神戸地方裁判所を第一審の専属的合意管轄裁判所とします。
言語
本規約は英語および日本語で提供され、同一の合意を表すことを意図しています。
両版に不一致がある場合、適用法令で認められる範囲で日本語版が優先します。利用者に適用される強行法規上の権利は影響を受けません。
